At Fawnwell, we value your privacy and are committed to protecting the personal information you share with us. This policy explains what data we collect, how we use it, and the rights you have regarding your information.

As a company based in the European Union (Netherlands), we process personal data in accordance with the GDPR.
Our online store operates under the shop name Fawnwell and primarily supplies goods to customers in the United States.

2. Information We Collect

We collect personal data that you provide when placing an order, creating an account, or contacting our customer service. This may include:

Full name
Address details (shipping & billing)
Email address
Phone number
Payment information
IP address and device information
Website usage and activity data

We collect this information to ensure a smooth shopping experience and to provide you with personalized service and support. Your name, shipping address and email address are needed to process your order; without them we cannot deliver it.

3. How We Use Your Information

Your data is used only for legitimate business purposes. For each purpose, this is the legal basis under the GDPR:

Processing and shipping your orders efficiently and accurately (necessary to perform our contract with you)
Providing customer service and support when you need assistance (performing our contract with you, or our legitimate interest in helping you)
Sending order updates (performing our contract with you), and promotions or relevant information only if you’ve opted in (your consent)
Improving our website and shopping experience through analytics and feedback (your consent for analytics cookies)
Detecting and preventing fraud and misuse of our store (our legitimate interest in a safe store)

We only share your information with trusted third-party service providers when it’s necessary to fulfill your order or maintain our operations, for example:

Our e-commerce platform (Shopify)
Our payment service provider Whop, which processes your payment and the details you enter in the payment form
Shipping and logistics partners, including our fulfillment partner in Asia
IT and hosting service providers
Analytics and advertising partners such as Google and Meta, only if you accept analytics or marketing cookies

All third parties we work with are required to handle your data securely and in compliance with applicable privacy laws.
We may also disclose information if legally required to do so by government or regulatory authorities.

5. International Transfers

Because we deliver to the United States and work with a fulfillment partner in Asia, your data is processed outside the European Union. For US companies certified under the EU-US Data Privacy Framework, we rely on the European Commission’s adequacy decision. For other recipients outside the EU, we use the European Commission’s Standard Contractual Clauses or another safeguard recognized under the GDPR. 6. Data Retention

We keep your data only as long as necessary to fulfill the purposes described in this policy, or as required by law.

Order, invoice and payment records: 7 years, as required by Dutch tax law.
Customer service messages: as long as needed to handle your question.
Checkouts that were started but not paid: usually deleted after 14 days. We keep them longer only when we need to check a payment problem.
Marketing emails: until you unsubscribe.

When personal data is no longer needed, it is safely deleted or anonymized.

7. Cookies

Our website uses cookies to enhance functionality, analyze traffic, and improve marketing performance.
Cookies help us remember your preferences and improve your shopping experience.
Analytics and marketing cookies are only used if you accept them. You can manage or disable cookies at any time through your browser settings.

8. Your Rights

We’ll respond to your request within one month, in accordance with applicable privacy regulations. For complex requests this can be extended by two months; we will let you know if that happens.

If you are not satisfied with how we handle your data, you have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl), or with the data protection authority where you live.

9. US State Privacy Rights

If you live in California or another US state with a consumer privacy law, you have the right to know what personal information we collect, use and disclose, to access, correct and delete it, and to opt out of the sale or sharing of your personal information and of targeted advertising. We do not sell personal information for money. We treat the Global Privacy Control (GPC) signal as an opt-out request for the browser that sends it. You may use an authorized agent to make a request; we may ask you to verify your identity. We will not treat you differently for exercising your rights.
